1. Acceptance

By accessing swiftduka.com or using SwiftDuka you agree to these Terms and to Meta Platform Terms and WhatsApp Business Terms.

2. Service

SwiftDuka is a WhatsApp Commerce Operating System for growing businesses. It helps businesses manage catalogs, orders and mobile money payments and delivery via the official WhatsApp Business Platform. SwiftDuka is operated by HEMMA Ventures Limited.

3. Eligibility

To use SwiftDuka you must be a registered business, own the phone number used for WhatsApp Business, complete Meta Business Verification and comply with WhatsApp Commerce Policy and applicable laws.

4. Your responsibilities

Provide accurate business information matching your registration documents.
Obtain opt in from customers before sending WhatsApp messages per WhatsApp Business Policy.
Do not use SwiftDuka for spam, illegal goods or prohibited content under Commerce Policy.
Keep your API keys and dashboard login confidential.

5. Fees

WhatsApp conversation fees charged by Meta apply per Meta pricing. SwiftDuka platform fees per your subscription plan. All fees in TZS inclusive of applicable taxes.

6. Intellectual property

SwiftDuka software, logo and content are owned by HEMMA Ventures Limited. You retain ownership of your catalog and customer data.

7. Meta integration

SwiftDuka integrates with Meta's WhatsApp Business Platform. Your use is subject to Meta Platform Terms, Developer Policies and WhatsApp Business Terms.

8. Disclaimer

Service is provided as is. We are not liable for indirect damages, loss of profit or failures by third party riders or payment providers.

9. Limitation of liability

Maximum liability limited to fees paid in the last three months.

10. Governing law

Governed by the laws of The United Republic of Tanzania. Disputes subject to jurisdiction of courts in Dar es Salaam.

11. Termination

We may suspend accounts violating these Terms or WhatsApp Policy. You may terminate by emailing emmanuel@swiftduka.com with thirty days notice.
